These Terms and Conditions set out the basis on which Waste Clearance Chelsea provides waste collection and related services to domestic and business customers. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings given below:

Customer means any individual, business, landlord, managing agent or organisation that requests or uses our services.

Services means waste clearance, waste collection, rubbish removal, bulky item collection, garden waste collection, commercial waste services, and any related work provided by us.

Waste means any items, materials, rubbish, refuse, debris, furniture, appliances or other goods that the Customer asks us to remove, subject to applicable regulations and these Terms and Conditions.

Quote means a price or estimate for the Services provided by us to the Customer verbally, by telephone, in writing, by email, or by other communication.

Contract means a legally binding agreement for the supply of Services formed between the Customer and Waste Clearance Chelsea in accordance with these Terms and Conditions.

2. Scope of Services

Waste Clearance Chelsea provides waste and rubbish clearance services within our designated service area, including residential and commercial locations. The exact scope of each job will be agreed with the Customer at the time of booking based on the information provided.

Our Services may include loading of waste from accessible areas, transportation, and disposal or recycling at authorised facilities. We reserve the right to refuse to handle any items that are not in line with our licence, are unsafe, unlawful to transport, or are otherwise unsuitable for collection.

We may subcontract certain elements of the Services to carefully selected partners, but we remain responsible for ensuring that services are delivered in accordance with these Terms and Conditions.

3. Booking Process

Customers may request a booking by phone, email, online form, or other advertised contact methods. When making a booking request, the Customer must provide accurate and complete information about:

the type and approximate quantity or volume of waste to be collected;

the location and access arrangements for the property;

any specific items that may require special handling; and

any time constraints or parking restrictions that may affect the collection.

Based on the information provided, we will issue a Quote or indicative estimate. The Quote may be provisional and subject to confirmation upon arrival if the actual volume, type or accessibility of the waste differs from the Customer’s description.

A Contract is formed when the Customer accepts our Quote or estimate and we confirm the booking, either verbally or in writing. We reserve the right to refuse any booking request at our discretion.

4. Pricing and Quotes

Prices are usually based on the estimated volume, weight, type of waste and the labour involved. Additional charges may apply for:

excessive weight or volume beyond the original estimate;

special waste streams that require separate treatment or disposal;

parking fees, tolls, congestion charges or similar costs incurred in providing the Services; and

wasted journeys or waiting time caused by the Customer’s failure to provide access or accurate information.

Unless otherwise stated, all prices are quoted in pounds sterling and are exclusive of any applicable taxes. We will use reasonable care to provide accurate estimates, but the final price may vary where the actual waste conditions differ from those described at the time of booking. Any variation in price will be explained to the Customer before work proceeds beyond the original scope.

5. Access and Customer Obligations

The Customer must ensure that we have safe, lawful and reasonable access to the property and to the waste that is to be collected. The Customer must:

obtain any necessary permissions for entry to the property or premises;

make sure that access routes are clear and reasonably safe for our staff and vehicles;

inform us in advance of any parking restrictions, security procedures or other access issues; and

ensure that the waste for collection is clearly identified and separated from items not to be taken.

If we are unable to carry out the Services due to inadequate access, incorrect information, or any failure by the Customer to comply with these obligations, we may charge a call-out fee or reasonable waiting time charges, or treat the booking as cancelled by the Customer.

6. Booking Changes and Cancellations

If the Customer needs to change or cancel a booking, they should contact us as soon as possible using the contact details provided at the time of booking.

Where reasonable notice of at least 24 hours before the scheduled collection time is given, we will normally cancel or reschedule the booking without charging a cancellation fee.

If the Customer cancels with less than 24 hours notice, or fails to provide access at the agreed time, we may charge a reasonable cancellation fee or call-out charge to cover costs incurred, including any staff, vehicle or disposal arrangements already committed.

We reserve the right to cancel or reschedule a booking due to vehicle breakdown, staff illness, severe weather, site safety issues, regulatory constraints or other circumstances beyond our reasonable control. In such cases, we will notify the Customer as soon as practicable and offer an alternative date where possible. We will not be liable for any loss caused by such cancellation or delay beyond the refund of any pre-paid service not delivered.

7. Payments and Invoicing

Unless otherwise agreed, payment for our Services is due on completion of the collection, prior to our team leaving the site. We accept various payment methods as communicated at the time of booking, which may include cash, card payments or bank transfers.

For business Customers or larger projects, we may agree alternative payment terms, including invoicing after completion. Invoices are payable within the period stated on the invoice. If no period is stated, payment is due within 14 days of the invoice date.

We reserve the right to charge interest on overdue amounts at the statutory rate permitted under applicable UK law, accruing on a daily basis until payment is received in full. The Customer will also be liable for any reasonable costs incurred in recovering unpaid sums, including legal fees and collection agency charges.

Title to any recyclable or reusable materials removed passes to us upon collection, unless otherwise agreed in writing.

8. Waste Types and Exclusions

We provide general waste, bulky waste, household rubbish, light construction waste and commercial waste collection, subject to applicable rules and our licence conditions. However, some materials are restricted or require prior agreement. The Customer must inform us in advance if any of the waste includes:

hazardous materials such as chemicals, solvents, asbestos, clinical waste, pressurised containers or industrial oils;

electrical and electronic equipment that requires specific processing;

liquids, paint, fuel or substances that may leak or spill; or

any other regulated or dangerous items.

We may refuse to collect any waste we reasonably consider to be hazardous, unsafe, illegal or beyond the agreed scope of the Services. If undisclosed prohibited items are discovered during or after collection, we may charge additional fees for safe handling, or require the Customer to retrieve them where safe and lawful to do so.

9. Compliance with Waste Regulations

Waste Clearance Chelsea operates in accordance with relevant UK waste management and environmental regulations. All waste that we collect is taken to authorised transfer stations, recycling centres, or disposal facilities, and we take reasonable steps to maximise recycling and responsible disposal.

Where applicable, we will issue or complete any required documentation for the transfer of controlled waste from the Customer to us or to a licensed facility. Customers must co-operate by providing accurate information about the waste being transferred.

The Customer warrants that they have the right to dispose of the waste and that it has not been obtained through theft or unlawful activity. The Customer agrees to indemnify us against any loss, damage, fine or claim arising from a breach of this warranty or failure to comply with waste legislation on their part.

10. Liability and Limitations

We will perform the Services with reasonable care and skill and will take reasonable steps to avoid damaging property during collections. However, the Customer is responsible for protecting flooring, walls, doors and other surfaces from damage where waste must be removed from inside a property.

We shall not be liable for any damage to the property or contents where such damage arises from:

pre-existing defects, weakness or poor condition of the structure or fixtures;

reasonable movement of bulky items through tight spaces or over unprotected surfaces; or

failure by the Customer to inform us of particular risks or to take reasonable protective measures.

Our total liability to the Customer for any loss or damage arising out of or in connection with the Services, whether in contract, tort or otherwise, shall be limited to the total price paid or payable by the Customer for the specific job giving rise to the claim, except where such limitation is not permitted by law.

Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be excluded or limited under applicable law.

11. Insurance

Waste Clearance Chelsea maintains appropriate insurance cover in respect of public liability and, where applicable, employer’s liability, in accordance with UK legal requirements and industry standards. Details of our insurance cover are available on request.

12. Customer Property and Valuables

The Customer is responsible for ensuring that no items of value or items intended to be kept are placed with the waste for collection. Once items have been loaded onto our vehicle, they may be immediately mixed with other waste and cannot usually be retrieved.

We accept no responsibility for the loss of any item mistakenly included in the waste unless such loss arises from our negligence and was clearly brought to our attention before loading. The Customer should carefully check that only unwanted items are presented for collection.

13. Events Beyond Our Control

We will not be liable for any delay or failure to perform our obligations under the Contract if such delay or failure results from events, circumstances or causes beyond our reasonable control. These may include extreme weather, road closures, traffic incidents, strikes, accidents, public emergencies, regulatory actions or other force majeure events.

If a delay occurs, we will use reasonable endeavours to rearrange the Services as soon as practicable. If performance is substantially prevented for a prolonged period, either party may terminate the affected Contract without penalty, and any pre-paid sums for unperformed Services will be refunded to the Customer.

14. Complaints and Dispute Resolution

If the Customer is dissatisfied with any aspect of our Services, they should contact us promptly with full details of the issue. We aim to respond to complaints within a reasonable timescale and to resolve them fairly where possible.

In the event of a dispute that cannot be resolved directly, either party may seek to use an appropriate mediation or alternative dispute resolution process before pursuing court proceedings, although this is not a mandatory requirement.

15. Data Protection and Privacy

We collect and process personal data about Customers only to the extent necessary to handle enquiries, manage bookings, perform the Services and administer our business. Personal information may include name, contact details, address and payment details.

We will keep such information secure and will not sell or disclose it to third parties except where required to deliver the Services, to comply with legal obligations, to enforce our rights, or where the Customer has given consent. By using our Services, the Customer acknowledges that their data may be processed for these purposes.

16. Variations to Terms

We reserve the right to update or amend these Terms and Conditions from time to time. Any changes will take effect when posted on our website or otherwise notified to Customers and will apply to Contracts formed after that date. Existing Contracts will continue to be governed by the version of the Terms and Conditions in force at the time the Contract was formed, unless otherwise agreed.

17. Severability

If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be treated as removed, but the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

18. Governing Law and Jurisdiction

These Terms and Conditions, and any Contract between Waste Clearance Chelsea and the Customer, are governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or any Contract, including any dispute relating to their existence, validity or termination.

19. Entire Agreement

These Terms and Conditions, together with any Quote and any written variations agreed between the parties, constitute the entire agreement between the Customer and Waste Clearance Chelsea in relation to the Services. The Customer acknowledges that they have not relied on any statement, promise or representation made or given by or on behalf of us that is not set out in these Terms and Conditions or in writing.
